1. Introduction
Welcome to SmoothOceanTrip ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at smoothoceantrip.sbs (the "Service") operated by SmoothOceanTrip.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
SmoothOceanTrip offers a range of exclusive yacht charter services, which include:
- Day-long yacht rentals
- Evening sailing trips
- Business getaways
- Private celebrations
- Extended yacht charters
All services are provided based on availability and prevailing weather conditions. We retain the right to alter or cease our services at our discretion.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you need to:
- Be of at least 18 years old
- Submit accurate and comprehensive information
- Make the necessary deposit as indicated in your reservation confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
A reservation is only deemed confirmed following the payment and our issuance of a written acknowledgment. We reserve the right to deny services to any individual at our sole discretion.
3.3 Availability
All yacht bookings are contingent upon vessel availability and appropriate weather conditions. We will endeavor to accommodate your requested dates and times as best as we can.
4. Payment Terms
4.1 Pricing
All fees are presented in € and encompass all relevant taxes unless stated otherwise. Fees are subject to change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the entire charter cost payable at the time of booking
- Final Payment: Expected no later than 48 hours before the charter commences
- Additional expenditure (if any): To be settled after the charter concludes
4.3 Payment Methods
We accept various forms of payment, including major credit cards, direct bank transfers, and certified checks. Transactions are securely processed through encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With more than 72 hours before departure: Entire refund except for processing costs
- Between 24-72 hours before departure: Refund of 50%
- Less than 24 hours before departure: No refund provided
5.2 Weather Cancellations
If our captain deems weather conditions to be unsafe, we will propose to either:
- Reschedule the charter to an alternative available date at no extra cost
- Issue a complete refund if rescheduling isn't an option
5.3 Mechanical Issues
Should there be a mechanical issue with the designated yacht, we will try to provide a suitable substitute. If a replacement is not available, we will issue a full reimbursement.
6. Safety and Conduct
6.1 Safety Requirements
All patrons must:
- Heed all directions from the crew
- Utilize the safety gear provided when necessary
- Inform of any health conditions that may affect their safe participation
- Stay within the designated areas on the vessel
6.2 Prohibited Items
The following are not allowed on the vessel:
- Glassware
- Illegal substances
- Weapons of any form
- Excess refreshments (beyond modest consumption)
- Animals (except with prior approval)
6.3 Conduct
Guests should act respectfully at all times. Should behaviour endanger safety or disrupt other guests' experience, we reserve the right to end the charter prematurely without providing a refund.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the price paid for your charter. Our responsibilities do not include:
- Personal harm due to guest negligence
- Theft or destruction of personal belongings
- Indirect or severe damages
- Delays due to weather or situations outside our reasonable control
7.2 Insurance Coverage
We have extensive marine insurance for our vessels and operations. Individuals are responsible for their own travel and personal insurance.
7.3 Assumption of Risk
When you partake in our charter services, you acknowledge the inherent dangers of marine activities and accept personal responsibility for your own safety and security.
8. Modifications and Itinerary Changes
We retain the right to modify itineraries, paths, or schedules due to factors like weather, safety concerns, or administrative needs. We will aim to offer equivalent alternative experiences whenever feasible.
9. Force Majeure
We are not accountable for postponements, cancellations, or changes due to incidents beyond our control, which include but are not limited to:
- Extreme weather scenarios
- Natural catastrophes
- Governmental decrees
- Seaport restrictions
- Vessel malfunctions
10. Privacy and Data Protection
We handle your personal details according to our Privacy Policy. Utilizing our services indicates agreement with the collection and use of your data as described in the Privacy Policy.
11. Intellectual Property
All material on our site, like texts, graphics, trademarks, and pictures, is governed by copyright and trademark laws. Unauthorized reproduction, distribution, or derivation is prohibited without our explicit consent.
12. Governing Law
The applicable laws of Germany dictate these Terms. Any disagreements are to be settled in the jurisdiction of the courts in Hamburg, Germany.
13. Changes to Terms
We may alter these Terms at any time. We will post revisions on our site with an updated amendment date. Continuous use of our offerings implies acceptance of the new terms.
